Carmel Valley short-term rental restrictions: Monterey County’s rules for stays of 30 days or less

Carmel Valley is mostly unincorporated Monterey County, so short-term rentals follow the county’s vacation-rental ordinances—not Carmel-by-the-Sea’s 30-day city rule. Buyers comparing the Valley to the village need both. Here is how the county defines vacation rentals, which license types exist, and the Carmel Valley Master Plan limit that blocks Commercial vacation rentals in residential zoning.

The short version: Monterey County defines a vacation rental as use of residential property for 30 calendar days or less. Only detached single-family dwellings (including manufactured homes on permanent foundations) qualify; ADUs, duplexes and multi-family units do not. Operators need a Vacation Rental Operation License, Transient Occupancy Tax registration and a business license; Commercial vacation rentals also need a Use Permit or Coastal Development Permit. Homestays and Limited rentals (up to three non-hosted stays per 12 months) have no numeric caps countywide. Commercial vacation rentals are capped by planning area and are prohibited in the residential zoning districts of the Carmel Valley Master Plan. Inland rules took effect October 14, 2024; coastal unincorporated rules October 24, 2025. Stays of 31 days or more are not regulated as vacation rentals by HCD.

What counts

What the county counts as a vacation rental

Thirty days or less

A vacation rental is use of all or part of residential property for 30 calendar days or less.

Single-family only

Allowed in detached single-family dwellings, including a mobile or manufactured home on a permanent foundation. Duplexes, condominiums, multifamily, ADUs, JADUs, temporary structures and farmworker housing are not eligible.

Guesthouse

A guesthouse may be included with the main house; it cannot be licensed separately as its own vacation rental.

Cities are separate

These county rules do not apply inside Carmel-by-the-Sea or other cities. For the village’s residential 30-day minimum, see Carmel-by-the-Sea short-term rental rules. For Del Monte Forest / Pebble Beach, see Pebble Beach short-term rentals.

License types

Homestay, Limited and Commercial

Homestay

Owner stays overnight in the home during the guest stay; the home must be the owner’s primary residence. No countywide numeric cap. Vacation Rental Operation License plus TOT and business license.

Limited Vacation Rental

Non-hosted whole-house rental up to three times per 12-month period. No countywide numeric cap. Same license stack as Homestay.

Commercial Vacation Rental

Non-hosted whole-house rental more than three times per 12 months. Needs the Operation License plus a Use Permit (inland) or Coastal Development Permit (coastal), and is subject to planning-area caps.

Fees (Operation License)

County materials cite a $965 Operation License fee component and a total around $1,152.40, plus possible Environmental Health fees if on well or septic. TOT, business license and land-use entitlement fees are separate. Confirm current fees before you budget.

Lawsuit note

As of the county’s Nov 5, 2026 page, certain ordinance provisions on non-resident vs resident Homestay treatment and corporate vs natural-person ownership are suspended from enforcement because of ongoing litigation. Other rules remain in force. Check the county page for the latest.

Carmel Valley limits

The Carmel Valley Master Plan rule buyers miss

No Commercial VRs in residential CV zoning

The county’s vacation-rental summary states Commercial Vacation Rentals are prohibited in the residential zoning districts in the Carmel Valley Master Plan. Commercial VRs in the Carmel Valley Master Plan area are listed only in commercial and visitor-serving type districts (for example LC, HC, VO, F, RG, PG, RC, CP, SP—not the residential HDR/MDR/LDR/RDR list used in other planning areas).

Homestay and Limited still available

Homestays and Limited Vacation Rentals remain allowed countywide with no numeric cap, including in Carmel Valley, subject to zoning and licensing.

Inland vs coastal

Two effective dates

Inland unincorporated

Ordinances operative October 14, 2024 (Title 21 section 21.64.290 and related license rules).

Coastal unincorporated

Board adopted September 23, 2025; operative October 24, 2025 (Title 20 section 20.64.290). Coastal Commercial VRs need a Coastal Development Permit.

Grace / phase-out

Operators who applied during the published grace windows may continue while applications are diligently pursued, subject to county action. Unpermitted coastal VRs have additional Coastal Commission certification notes on the county page—read the current county notice if you are buying an operating rental.

Existing licenses

Private restrictions

CC&Rs and HOA rules are separate; the county will not enforce them for you.

Underwrite 31+ days if needed

If short-term use is restricted, a 31-day minimum stay is outside HCD’s vacation-rental definition—still confirm tax, HOA and insurance rules.

Carmel Valley short-term rentals: quick questions

Does Carmel Valley allow Airbnb-style rentals?

Unincorporated Carmel Valley follows Monterey County vacation-rental rules. Homestays and Limited (up to three non-hosted stays per year) are allowed with licenses. Commercial vacation rentals are prohibited in Carmel Valley Master Plan residential zoning districts.

What is the maximum stay that counts as a vacation rental?

Thirty calendar days or less. Stays of 31 days or more are not regulated as vacation rentals by county HCD.

Can I rent an ADU short-term in Carmel Valley?

No. ADUs and JADUs are not eligible dwelling types for a county vacation rental.

What permits do I need?

At minimum: TOT certificate, Vacation Rental Operation License and a business license. Commercial VRs also need a Use Permit or Coastal Development Permit.

When did the new county rules start?

Inland unincorporated: October 14, 2024. Coastal unincorporated: October 24, 2025.

Is Carmel-by-the-Sea the same?

No. The city has its own short-term rental rules, including a 30-day minimum in the residential district. See the Carmel-by-the-Sea rental guide on this site.

Do HOA rules still matter?

Yes. The county does not enforce private CC&Rs. A county license does not override an HOA ban.
