Inherited a home in Carmel-by-the-Sea, Carmel or Pebble Beach? Prop 19, property taxes, and your options

Many homes here have been in the same family for decades, with property tax bills far below what a new owner would pay. Since February 16, 2021, Proposition 19 decides whether that low tax base survives an inheritance, and for most homes here it only partly does. Here’s how it works, the deadlines that matter, and how to think about keeping, renting or selling.

The short version: Under Proposition 19, a home passing from parent to child keeps its old taxable value only if it was the parent’s principal residence and becomes the child’s principal residence, with the homeowners’ exemption filed within one year. Even then, the protection is capped at the old taxable value plus $1,044,586 (for transfers February 16, 2025 – February 15, 2027); anything above that is added to the tax base. If no child moves in, or it’s kept as a second home or rental, the home is reassessed at market value. With median prices above $3M in Carmel-by-the-Sea and Pebble Beach, most inherited homes here will see at least a partial reassessment.

The rule

How Proposition 19 treats an inherited home

For parent-to-child (and some grandparent-to-grandchild) transfers on or after February 16, 2021. Earlier transfers fall under the old Propositions 58 and 193.

It must be a family home

The exclusion covers a family home that was the parent’s principal residence and becomes the child’s principal residence, or a family farm. A rental home, or a parent’s second home, doesn’t qualify.

Someone has to move in

At least one eligible child must live in the home as their principal residence and file for the homeowners’ (or disabled veterans’) exemption within one year of the transfer. If the child later moves out, the home gets a new taxable value as of the next lien date.

The value cap

Even when it qualifies, the protection is limited to the home’s taxable value at transfer plus $1 million, adjusted every two years: $1,044,586 for transfers from February 16, 2025 through February 15, 2027. Market value above that limit is added to the taxable value.

If it doesn’t qualify

The home is reassessed at its market value as of the transfer, and the new owner pays the roughly 1% base rate plus local charges on that value. See Carmel and Pebble Beach property taxes.

The math

What the cap looks like here

The Board of Equalization’s own example, then what it means at Carmel and Pebble Beach prices.

BOE’s example

A family home with a factored base year value of $300,000 and a market value of $1,500,000. Using the original $1,000,000 allowance, the limit is $1,300,000. The $200,000 above it is added, so the new taxable value is $500,000 instead of $1,500,000.

At today’s allowance

For a transfer between February 16, 2025 and February 15, 2027, the same math uses $1,044,586 instead of $1,000,000.

Why it matters here

Monthly median sale prices for single-family homes averaged $3.47M in Carmel-by-the-Sea, $3.21M in Pebble Beach and $2.47M in the Carmel area over October 2025 – September 2026. A long-held home here can easily be worth more than its old taxable value plus $1,044,586, so even a qualifying child usually sees the tax base rise.

Get a value as of the date

The assessor works from market value on the date of transfer. A date-of-death value is also what heirs generally use as their federal tax basis, so it’s worth documenting carefully. Start with a home valuation.

Assessor

Report the death

When a property owner dies and the home passes through probate or a trust, the successor trustee or personal representative must file a Death of Real Property Owner change in ownership statement with the county assessor. File it promptly to avoid problems with reassessment.

Your options

Keep it, rent it, or sell it

Each choice changes the tax picture.

Keep it and live there

The only path to the parent-child exclusion. You get the old taxable value up to the cap, as long as one of you keeps living there as your principal residence.

Keep it as a second home

Many homes here are second homes. A second home doesn’t qualify, so it’s reassessed at market value. Budget for the full tax bill, insurance, and upkeep.

Rent it out

A rental doesn’t qualify either. Rental rules also differ by location: Carmel-by-the-Sea has a 30-day minimum in its residential district, and Monterey County regulates stays of 30 days or less in the Carmel area and Pebble Beach. See Carmel-by-the-Sea rental rules and Pebble Beach rental rules.

Sell it

Heirs who sell often face little capital gain, because the federal tax basis of inherited property is generally its fair market value on the date of death (or an alternate valuation date). Confirm with your tax advisor.

If you sell

Selling an inherited home: what’s different

Some paperwork changes when an estate or trust sells.

Disclosures

California’s transfer disclosure statement doesn’t apply to most sales by a trustee or executor administering a trust or estate. It does still apply when the trustee of a revocable trust is a natural person who is a former owner or lived there within the past year. Known material problems should still be disclosed; ask your attorney.

Water retrofits still apply

MPWMD Rule 141 water-efficiency retrofits are triggered by every change of ownership. The seller or the buyer can do the work, and a buyer can get up to six months.

Older homes

Many long-held homes predate 1978, so the federal lead-based paint disclosure and pamphlet usually apply. See home selling tips for the full seller checklist.

Siblings and timing

When several heirs share a home, agreeing on a value and a plan comes first. A clear, documented market value helps everyone. Then see selling in Carmel-by-the-Sea, selling in Carmel or selling a Pebble Beach home.

Step by step

A sensible order of operations

1. Secure the house

Insurance, utilities, locks, and a walk-through. Vacant homes need attention.

2. Bring in your advisors

Estate attorney for probate or trust administration; tax advisor for basis and Prop 19.

3. File with the assessor

Death of real property owner statement now; homeowners’ exemption within one year if a child moves in; BOE-19-P within three years.

4. Document the value

A market value as of the date of death supports the assessor’s review and your tax basis.

5. Decide: keep, rent or sell

Run the numbers with the new taxable value, not the old bill.

6. If selling, prepare well

Pre-listing inspection, permit and water history, and a pricing plan built on local sales.

Inherited homes: quick questions

Does an inherited home get reassessed in California?

Usually, at least in part. Under Proposition 19, a parent-to-child transfer avoids reassessment only if the home was the parent’s principal residence and becomes the child’s principal residence, and only up to the old taxable value plus $1,044,586 for transfers from February 16, 2025 through February 15, 2027. Otherwise it is reassessed at market value.

What if I inherit my parents’ home but don’t move in?

It doesn’t qualify for the parent-child exclusion and is reassessed at market value as of the transfer.

How long do I have to move in and file?

At least one eligible child must live there as a principal residence and file the homeowners’ or disabled veterans’ exemption within one year of the transfer. If filed later, the exclusion applies only going forward.

When is the BOE-19-P claim due?

Within three years of the date of death or transfer, or before the home is transferred to a third party, whichever is earlier.

What happens if I move out later?

The home gets a new taxable value as of the next lien date: its market value on the date you inherited it, adjusted for inflation since.

Can I keep my parents’ low property tax on a rental?

No. Proposition 19 limits the exclusion to a family home that becomes the child’s principal residence, or a family farm. Rentals and second homes don’t qualify.

Will I owe capital gains tax if I sell an inherited home?

Often little, because the federal basis of inherited property is generally its fair market value on the date of death. Confirm with a tax advisor.

Does the estate have to give a transfer disclosure statement?

Not for most sales by a trustee or executor administering a trust or estate. The exemption doesn’t apply when a natural-person trustee of a revocable trust is a former owner or recent occupant.

Who do I notify when a homeowner dies?

The successor trustee or personal representative files a Death of Real Property Owner change in ownership statement with the Monterey County Assessor.
